Australia GP: Rossi's Illegal pass video.

now don't go whoring this and kicking up the bandwidth on youtube, but this is the illegal pass. A HUGE yellow flag is CLEARLY being waved (20 seconds into the video) and Rossi overtakes Stoner (riskfully) who was slowing down with the rest of the pack.

i don't see it that way, he was trying to pass, with lots of riders around and flag is not in the corner, i do think he didn't see it.

nobody argues whether he saw it or not.
the argument is that NO penalty was imposed when there clearly was an infraction.

the argument is with the race officials letting Rossi get away with it.
To the racers, things happen instantly and they must focus on riding at all times. No question there.
The officials must focus on everything else involving the track.

Does seem like he noticed it and backed off a little to let Stoner pass again.

Doesn't matter whether he saw it at the time or not. If he saw it then he has a chance to rectify the mistake immediately. If he passes the flag without doing so, there should be a sign waiting for him at the pits to do a ride through as a penalty. If he choses not to heed that penalty, he can be subject to another penalty at the end of the race, either fines, suspension for one race, or as precedence, a 10 second docking of his final lap time. Again, it doesn't matter if he saw it or not. The fact is: Penalty was not given.

By the way, allowing Stoner to pass again (which he clearly didn't) isn't the rule. The rule is that Rossi must raise his hand, admitting the fault, allow the rider to re-pass and continue racing.

But that doesnt mean anything though. The rules dont say No Passing unless you are racing hard, then keep fighting it out. The flags are there for everyone's protection and safety. Ignoring them or missing them and not being penalized for it is dangerous and unsafe.
